I Always Thought You Guys Were On the Same Side 

The Ninth Circuit Court of Appeals has ruled that it was neither arbitrary nor capricious for the Army Corps of Engineers to determine that a proposed development presented no threat to the pygmy owl's habitat.

The case is captioned Defenders of Wildlife v. Flowers. I did not make that up.
